What is a disregard LLC?

A disregarded LLC refers to a LLC owned by a single member, according to the IRS. Unless a single-member LLC chooses otherwise, the IRS treats it as a sole proprietorship and does not tax the LLC. Instead, profits from the LLC flow through the owner’s personal taxes.

Does a disregarded LLC need an EIN?

Most new single-member LLCs classified as disregarded entities will need to obtain an EIN. A single-member LLC that is a disregarded entity that does not have employees and does not have an excise tax liability does not need an EIN. It should use the name and TIN of the single member owner for federal tax purposes.

Can a LLC be treated as a disregarded entity?
