You may want to file a Married Filing Separately tax return if one or more of the following situations apply to you: You and/or your spouse owe unpaid taxes or child support (filing a joint tax return may result in the IRS offsetting your refund to pay the taxes)

Do I have to file MFS?

MFS isn’t the equivalent of two single individuals filing their taxes and applying whichever tax rules they want independent of what the other spouse is doing. You have to report your separate income and deductions on your tax return and also include half of your combined community income and deductions.
