Is spousal support based on gross or net?

In California, it can be described that spousal support calculations are based on net income. However, that can be misleading because what that means in practice, is we begin with gross income, then apply a uniform, statutory list of allowable deductions.

How long does spousal support typically last?

A general rule is that spousal support will last for half the length of a less than 10 years long marriage. However, in longer marriages, the court will not set alimony duration. The burden will be on the party who pays to prove that spousal support is not necessary at some future point in time.

Is there a time limit on paying spousal support?

For longer-term relationships, as well as in cases where the parties’ have children, the courts generally do not place a time limit on alimony. This does not mean you’ll need to pay spousal support forever or that you’ll receive spousal support forever.

How much does Social Security spousal benefit per month?
