To end your tenancy in one of these ways, you must:
- give the landlord/agent a written termination notice and vacate – move out and return the keys – according to your notice, and/or.
- apply to the NSW Civil & Administrative Tribunal (NCAT) for a termination order.
Can a lease be changed?
A signed lease or tenancy is not simply a piece of paper. It sets out what was agreed between the parties – and in most cases is therefore a contract or binding legal agreement. In general, no matter how unfair some of the terms of your lease may be, you cannot amend those terms without the consent of your landlord.
How can I get out of my lease without a early termination clause?
If there is no escape clause you can ask to be let out of the lease if you either help find a replacement tenant, pay part of the remaining rent or were such a delightful tenant that the landlord is sad to see you go and lets you out without conditions knowing you will recommend them to others.
What happens if I breach the terms of my lease?
If you are found by the court to be in breach of the lease, the court could order you to pay damages, legal costs and/or ask you to put right any breach if it is possible to do so. The landlord may also seek possession of your flat which is also referred to as forfeiture.
How do I change my lease terms?
If you are a leaseholder, you cannot change the lease terms without agreeing such change with your landlord. The reason for this is that as the lease is a contract between two parties, the leaseholder and the landlord, both parties must agree to change (referred to also as variation) of the terms of the lease.

Can you terminate tenancy agreement early?
You can only end your fixed term tenancy early if your agreement says you can or by getting your landlord to agree to end your tenancy. If your agreement says you can end your fixed term tenancy early, this means you have a ‘break clause’. Your tenancy agreement will tell you when the break clause can apply.
