Generally, to qualify for head of household filing status, you must have a qualifying child or a dependent. However, a custodial parent may be eligible to claim head of household filing status based on a child even if he or she released a claim to exemption for the child.
What if my child’s father claimed my child on his taxes?
If you are the custodial parent and If someone else claimed your child inappropriately, and if they file first, your return will be rejected if e-filed. You would then need to file a return on paper, claiming the child as appropriate. The IRS will process your return and send you your refund, in the normal time.

How old do you have to be to claim Head of Household?
The child must be under 19 — unless she’s disabled or a full-time student — and younger than you. You must provide half her support for the year and she has to live with you at least six months of the year for which you are filing.
Can You claim your ex as Head of Household?
You also can’t claim her if your ex is using her to qualify for head of household status. If you claim one of your parents as a dependent, that also qualifies you to file as a head of household.
