In short, an ex-spouse does not qualify you to claim Head of Household (HOH), and if you do not have a qualifying dependent to claim HOH, you should not claim this status. In order to qualify as a “qualifying dependent” for HOH the person must be properly related to you.

Under what circumstances if any may an ex-spouse be claimed as a dependent?

You can claim your ex-wife as a dependent if her gross income is less than $4,050 for the year (SS income is not included) and if you provided more than half of her total support, and she lived with you for the entire year.

Can you file Head of Household if your ex-spouse claims?

Individuals who were separated but not divorced on Dec. 31 can possibly assert that they should be considered unmarried. Can a child be a Head of Household?

If your child is married, you must claim him as a dependent and he cannot file a joint tax return with his spouse. If your children lived with your former spouse for most of the year and she claims them as her dependents, you might still be eligible for head of household status.
