Can a landlord ask if you are married?

Federal Laws on Marital Status The Federal Fair Housing Act considers a person’s familial status a protected class. The federal law does not prohibit landlords from denying an application based on whether a prospective tenant is unmarried, married or divorced.

Should my spouse be on the lease?

There is no law that says you and your spouse must sign a lease when you rent a home together. There’s also no law that demands her name goes on the lease if she moves into a house you’re already renting.

Can you lie about who your landlord is?

Calling your rental applicant’s previous landlords for a reference is standard practice in tenant screening. Regardless of the reason, lying on a rental application is a major tenant screening red flag. If you discover your applicant has lied about a rental reference, you can (and should) deny them housing.

Can my landlord put rent up?

Your landlord can’t increase your rent during your fixed term unless you agree or your agreement allows it. If your agreement says your rent can be increased it has to say when and how it will be done. This is known as having a ‘rent review clause’.
