Can a child with special needs be excluded?

It is unlawful to exclude a child because the school says it can’t meet the child’s SEN. The school must look at putting alternative provisions in place and assessing what additional support the child requires. However, if the school is not able to deal with a child’s SEN they are able to manage a school transfer.

Can you exclude a child with send?

Head teachers should, as far as possible, avoid permanently excluding any pupil with a statement of SEN or EHCP or a ‘looked after’ child. Schools should engage proactively with parents in supporting the behaviour of pupils with additional needs.

There is no need to have a diagnosis prior to starting the EHCP process. The only difference is that students without a diagnosis will be assessed by the criteria for those young people with Social Emotional And Behavioural Difficulties, rather than on the Autism framework.
