Many nonprofit 501(c)(3) organizations provide funds, goods, and/or services to communities outside of the United States in furtherance of their respective charitable missions. Such work is important on so many levels and is widely understood to benefit our country through the goodwill created internationally.
Can you call yourself a nonprofit without 501c3?
If the nonprofit isn’t expecting to seek donations, they don’t need 501(c) status (since no donors will need a tax write-off). Nonprofits without 501(c) can still receive extra benefits from the state in which they are formed, such as qualifying for special grants or paying no sales taxes.
Do you need a 1099 for a foreign contractor?
As long as the foreign contractor is not a U.S. person and the services are wholly performed outside the U.S., then no Form 1099 is required and no withholding is required. However (Treas. Reg. §1.1441-1 (b) (3)), it is generally easier to ask them to complete a Form W-8BEN.

While there are different versions of Form 1099s, the one that most nonprofits should be aware of is Form 1099-MISC. This must be issued whenever $600 or more is paid to a non-employee for services. For example, this could be fees paid to consultants, contractors or temporary laborers.
